Terms of Service
Welcome to Stack. These Terms of Service ("Terms") govern your access to and use of the Stack mobile application and related services (collectively, the "Service") provided by Stack ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use Stack. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
2. Not Medical Advice
Stack is a tracking and analytics tool. It is not a medical device, and it is not a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of a qualified healthcare professional regarding any medical condition, medication, peptide, hormone, or supplement.
- Never disregard professional medical advice or delay seeking it because of something you have read or computed within Stack.
- Information about compounds, dosages, reconstitution, and protocols is provided for informational and tracking purposes only.
- You are solely responsible for the legality, safety, and appropriateness of any substance you choose to track within the App.
3. Your Account
If you create an account, you are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at support@whatsyourstack.app of any unauthorized use.
4. Subscriptions, Billing & Renewals
- Stack is offered on a paid subscription basis at $9.99 per week or $49.99 per year. Subscriptions are billed through your Apple ID.
- Subscriptions auto-renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions at any time in your Apple ID account settings.
- Payment will be charged to your Apple ID at confirmation of purchase.
- Prices are subject to change. We will provide reasonable notice of price changes before they take effect.
5. Refunds
All purchases are processed by Apple and are subject to Apple's refund policy. We do not directly process refunds. To request a refund, visit reportaproblem.apple.com.
6. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your personal, non-commercial use on devices you own or control.
7. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to violate any applicable law or regulation.
- Resell, sublicense, or commercially exploit the Service or its content.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated means to access the Service without our prior written consent.
8. Your Content
You retain all rights to the data and content you create within Stack ("Your Content"). You grant us a limited license to host, process, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content.
9. Intellectual Property
The Service, including all software, design, text, graphics, and trademarks, is owned by Stack and protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STACK AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Stack and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, unless prohibited by your local law.
15. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide reasonable notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
